In this session, Karen Brookman discussed industry challenges we all face
that can be particularly challenging in our current economic climate. The
need for many of us to go “Back to Basics” of superior business operations
served as the theme of the session and topics of performance excellence, razor
focused client service, and financial responsibility were discussed as proven
successful resolutions to these challenges, today and in the future.

In-House vs. Outsourced Discovery Management
Presented by William Kellermann
Some see In-house vs. Outsourced Discovery as a competitive Battle Royale pitting
electronic discovery professionals from litigants, outside counsel and support
vendors against one another. In fact, like the MIT Blackjack Team, we are all key
players in a high-stakes contest and must learn to work together. This session
outlined the factors that drive management and operations of electronic discovery
projects into litigant self-service, law firm or support vendor teams. The session
served to illuminate the common ground and common practices all electronic discovery
professionals should embrace and highlighted a strategy and mechanism for planned
hand-offs to meet the challenge of unexpected events in the course of electronic
discovery during the pendency of a matter.

Forensics: The Things You Need to Know
Presented by John Auman and Charles Adams
The forensic acquisition of data for electronic discovery is a complex yet essential
part of litigation. In this session, forensics experts John Auman and Charles Adams
discussed the many important facets of this process. Mr. Auman provided a brief overview
of a forensics investigation, complete with tips for a successful acquisition and
examination, including the planning, acquisition stage, and the forensic examination
itself. Mr. Adams then spoke on the litigation process by detailing how forensics
investigation and ESI processing play hand-in-hand and how a forensically sound
collection is a critical part of the ESI Processing workflow.
